Case Overview:

During the course of the child’s delivery, there was a failure to abandon vaginal delivery in favour of emergency Caesarean section delivery when after 3 pulls of a correctly applied instrument, delivery of the baby was not imminent.

The child suffered brachial plexus injury affecting the left shoulder and that led to Erb’s palsy affecting the upper limb.

In advance of the trial date, the case was successfully settled for a significant sum, which included the Plaintiff’s legal costs.
